Email: U.S. federal law does not require prior consent for commercial email, but every message must comply with the CAN-SPAM Act, which according to the FTC “makes no exception for business-to-business email.” The requirements include accurate header information, a subject line that is not deceptive, identification of the message as an ad, a valid physical postal address and an opt-out that you honor within 10 business days (FTC, CAN-SPAM Act: A Compliance Guide for Business).
Phone and text: calls and text messages are regulated more strictly. The federal rules under the Telephone Consumer Protection Act (47 CFR § 64.1200) and the Florida Telephone Solicitation Act (Fla. Stat. § 501.059) restrict autodialed and prerecorded sales calls and texts made without prior express written consent, and both the National Do Not Call Registry and the Florida Do Not Call list must be honored where they apply.
An export contains no consent of any kind. Our data is not screened against any do-not-call list, including the National Do Not Call Registry and the Florida Do Not Call list. How Fla. Stat. § 501.059(4) applies to business records that include phone numbers is a question for an attorney, and no Florida dataset with phone numbers will be released until that question is resolved.
